Terms and conditions
The following Terms form the promotion information for the Ultimate Ashes Ticket Competition (“Competition”).
1. These Terms are entered into by Specsavers Optical Group Limited of La Villiaze, St Andrews, Guernsey GY8 0AL (“Promoter”) and the entrant.
2. By entering this Competition, the entrant will be deemed to have read and understood these Terms and to have agreed to be bound by them. If the entrant does not agree with any of these Terms, they should not enter the Competition.
3. The Competition will run from 09:00 on Monday 29th July 2019 and closes on 23:59 on Sunday 11th August 2019 (‘Entry Period’). Entries received after the Entry Period will not be valid for entry into the Competition. Entries or claims that are incomplete or late or those not in accordance with all the entry instructions are invalid.
4.1 Entrants must meet the eligibility requirements as specified herein. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of any prize.
4.2 The Competition and its prize(s) are open and available to residents of the United Kingdom, the Channel Islands, Isle of Man or the Republic of Ireland aged 18 years or over, excluding employees of the Promoter and their immediate families, the Promoter's agents or anyone professionally associated with the Competition.
4.3 Entrants must be eighteen (18) years old and over. Proof of identification and age may be required at the request of the Promoter. If an entrant under the age of eighteen (18) enters the Promotion, the entry will be disqualified.
4.4 By entering, the winners agree to participate in any publicity or promotional activities as may be reasonably required by the Promoter with no further recompense. Further the Promoter reserves the right to use the names and counties of winners in any publicity relating to the Competition.
4.5 No purchase is necessary to enter the competition.
5. Method of Entry:
5.1 The Competition can be entered for free and requires a computer of device with internet access. To enter the prize draw, Qualifying Entrants must, within the Entry Period, fill in a dedicated Ultimate Ashes Ticket Competition webform on the Specsavers’ website. All steps in the entry process must be completed.
5.2 The Entrant must ensure that their entry include the following:
- Postal address
- Phone number;
- Email address;
- Country of resident; and
- Entry for the England vs Australia Competition on Saturday 24 August 2019 or the England vs Australia Competition on Saturday 14 September 2019.
5.3 Each entry is subject to approval by the Promoter at their absolute discretion.
5.4 Any entry that is deemed as offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information will not be granted approval and will therefore be excluded from the Competition.
5.5 The Promoter accepts no liability for entries not successfully completed due to a technical fault (technical malfunction, computer hardware or software failure, satellite, network or server failure, network incompatibility) of any kind. The Promoter accepts no responsibility for any entries which are not completed for any reason.
5.6 All entries will be moderated to ensure they meet the criteria set; any not meeting the minimum criteria will be disqualified.
5.7 One entry per person will be eligible to win. No bulk entries are permitted.
5.8 Entrants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion. No entries from agents, third parties, organised group or entries automatically generated by computer will be accepted.
6.1 There will be two (2) winners selected from the Qualifying Entrants who will each win the following prize consisting of:
2 X (Shared) Hospitality Entrance tickets for the England vs Australia Competition - 3rd Specsavers Ashes Series Test Match 2019 – Day 3 on Saturday 24 August 2019 from 11:00 - 20:00 at the Yorkshire Cricket Ground (in Leeds, United Kingdom) with the value of £698 ex VAT including a behind the scenes tour for the winner and guest of the Yorkshire Cricket Ground; or
2 X (Shared) Hospitality Entrance tickets for the England vs Australia Competition - 5th Specsavers Ashes Series Test Match 2019 - Day 3 on Saturday 14 September 2019 from 11:00-20:00 at the Kia Oval (in London, United Kingdom) with the value of £1078 ex VAT including a behind the scenes tour for the winner and guest of the Kia Oval media centre and a 15 minute meet and greet with David “Bumble” Lloyd.
6.2 The prize does not include transport to or from the Yorkshire Cricket Ground stadium or Kia Oval stadium, any food and beverage costs or any other expenses unless expressly agreed in writing by the Promoter throughout the day.
6.3 Each Qualifying Entrant who has entered a valid Entry into the prize draw over the duration of the Entry Period will be entered into the prize draw. The draw will take place on 12:00 on Monday 12 August 2019. The winner will be selected from the Qualifying Entrants, at random, by Promotor, using a random number generator.
6.4 The winner shall be responsible at all times for any act or omission of their guests.
6.5 Both the winner and guest agree to comply with all relevant ticket terms and venue terms and conditions of the Yorkshire Cricket Ground stadium or Kia Oval stadium, including dress codes, alcohol consumption and all other applicable terms as may be notified to the winner.
6.6 The winner will be notified by email or telephone using the details provided at entry within five (5) days of the Competition closing. If a winner does not respond to the Promoter within three (3) days of being notified by the Promoter, then the winner's prize will be forfeited, and the Promoter will be entitled to select another winner.
6.7 Each prize is non-exchangeable, non-transferable and non-refundable and there is no cash alternative in whole or in part unless otherwise stated above. The Promoter reserves the right to terminate or modify the Competition, modify these Terms prior to the closing date, vary details of the prize, or substitute a prize of equivalent value should unforeseen circumstances require it. The Promoter is entitled to terminate or modify the Competition or to modify these rules prior to the closing date by prior notice.
6.8 The Promoter shall not be liable for any prizes which are lost, delayed or damaged in the post or otherwise not received by the winner.
6.9 The odds of winning will depend on the total number of valid entries received.
7.1 The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which the entrant must provide within fourteen (14) days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms or any instructions forming part of this promotions entry requirements or otherwise where a participant has gained unfair advantage in participating in the Competition or won using fraudulent means. The Promoter will be the final arbiter in any decisions and these will be binding, and no correspondence will be entered into in relation this clause.
7.2 The prize is supplied by Specsavers.

7.5 The Prize will be fulfilled by the Promoter’s agency, CSM Sport and Entertainment LLP of PO Box 70693, 62 Buckingham Gate, London SW1P 9ZP.
7.6 The Promoter shall pass on relevant information to CSM for the purposes of prize fulfilment. The prize winners will be contacted by CSM to arrange redemption of the prize and will schedule meeting with the respectively winners on Saturday 24 August 2019 at the Yorkshire Cricket Ground or Saturday 14 September 2019 at the Kia Oval where the winners and guest will receive their Prize and will provided them the times and/or access badges for the behind the scenes tour and/or meet and greet.
7.7 In consideration of each Entrant’s entry into this competition and being afforded the change to win a prize, each Entrant agrees, where they are selected as winners, to the Promoter’s use of their personal information, and/or images taken during England vs Australia Competition on Saturday 24 August 2019 or the England vs Australia Competition on Saturday 14 September 2019 by and with the winners and guest freely for promotional activities. As an Entrant you, acknowledge and agree that the Promotor’s is permitted to use your personal information and/or image pursuant to this contract with the Promotor (and not by reference to consent).
7.8 In the fullest scope admitted by generally binding provisions of local law:
7.8.1 The Promoter and its group companies, its agencies and contractors shall not be liable for any damage, loss, injury or disappointment suffered by any participant entering the Competition or as a result of accepting the Prize.
7.8.2 The Promoter and its group companies, its agencies and contractors shall not be liable for any problems or technical malfunction of any computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the internet, or at any website, including any injury to or resulting from participation or downloading of any materials in the Competition.
7.8.3 However, nothing shall exclude the liability of the Promoter and its group companies, its agencies and contractors for death or personal injury as a result of its negligence.
7.9 The Competition is, to the fullest extent permitted by the local laws of the territory of the entrant, governed by English law and jurisdiction. This competition is voidable, at the discretion of the Promotor – where it is deemed to be prohibited by local law.
7.10 Under English law, Promoter shall not be liable to pay any tax on the Prize. If any applicable taxes are due on any element of the Prize such taxes shall be paid by the winner, to the fullest extent permitted by the law of each applicable jurisdiction. It is the responsibility of winners to report their Prize to the relevant authorities and to pay any applicable tax or duties including without limitation custom duty and related taxes, if and when applicable.
7.11 A person who is not a party to this agreement shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms.
7.12 The invalidity, illegality, or unenforceability of the whole or any part of the Terms does not affect or impair the continuation in force of the remainder of the Terms.
